Welcome to PetNimbus! These Terms and Conditions ("Terms") govern your use of the PetNimbus mobile application and services (collectively, the "Service"), provided by GoodShift Private Limited ("Company", "we", "us", or "our"), a company incorporated under the Companies Act, 2013 (CIN: U63122BR2026PTC081407).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, strictly do not use the Service.
● Age Requirement: You must be at least 18 years old to use PetNimbus. By using the Service, you represent and warrant that you are of legal age to form a binding contract.
● Pet Ownership Authority: You represent that you are the lawful owner or the authorized guardian of any pet for which you provide data, create listings, or manage records on the platform. Posting data for pets you do not own or have authorization for is strictly prohibited.
● Accuracy of Information: You must provide accurate, current, and complete information (including Name, Phone Number) during registration.
● Identity Verification (KYC): To ensure a safe community, we reserve the right to request government-issued identification (e.g., Aadhaar, PAN, Voter ID) to verify the identity of users. This is mandatory for verified breeders, NGO representatives, and users accessing sensitive features.
● Pet Documentation: To validate pet listings, we require valid proof of ownership and health history, including Vet Booklets, Vaccination Records, or Medical Certificates. We reserve the right to reject any listing that lacks verifiable documentation.
● Security: You are responsible for maintaining the confidentiality of your login credentials (OTP, Device access). You must notify us immediately of any unauthorized use.
● Termination Rights: We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
PetNimbus offers a comprehensive platform for pet owners to:
● Health Management: Digital storage for vet records, vaccination history, and weight logs.
● Adoption: A community platform for listing pets for free re-homing.
● Mating (Paid): A professional matching service for verified pets.
● Lost & Found: A community alert system to help locate missing pets.
● Directories: Access to third-party Vet and Groomer contact information.
● Gamification: A system to earn badges and points for community contributions.
Disclaimer Regarding Phase 1 Features:
Some features visible in the application (such as Vet Directory, Grooming Booking, etc.) may be in Beta or Information Only mode. Listings for these services may be static placeholders or directories provided "asis" without real-time booking capabilities.
A. Prohibited Content & Brand Protection
You agree NOT to post or engage in:
● Fraud: False, misleading, or fraudulent listings.
● Abuse: Content that promotes animal cruelty, abuse, or illegal breeding practices (e.g., puppy mills).
● Privacy Violations: Posting personal contact information in public listing descriptions (to prevent spam/scams).
● Brand Misuse: You shall not use screenshots, video recordings, or any content from the PetNimbus app to disparage, defame, or misrepresent the brand on social media or other platforms.
● Fake Validation: Using app screenshots to falsely claim "verification" or "approval" by PetNimbus for external transactions or scams is strictly prohibited and will lead to legal action.
B. Adoption Rules (Free Service)
● No Pet Sales: We strictly prohibit the sale of pets for profit on our Adoption platform. The platform is dedicated solely to re-homing.
● Zero Fees Constraint: The act of adopting a pet from another user must be free of charge (no "price" for the pet).
○ Clarification: This "Free" rule applies to the pet transfer transaction between users. You are still required to pay PetNimbus for App Subscriptions to access features, but you cannot charge another user money for the animal itself.
● Data Transfer Consent: By transferring a pet to a new owner via the App's "Transfer" feature, you explicitly consent to the transfer of that pet's historical data (including past medical records, photos, timeline events, and habits) to the new owner's account. This ensures continuity of care for the animal.
● No Adoption Guarantee: We do not guarantee that you will find a suitable adopter for your pet. We are not responsible if no inquiry is received.
C. Mating Rules (Paid Service)
Mating is a specialized, paid subscription service. Unlike Adoption, this is not a free feature.
● Subscription Required: You must purchase a specific Mating Subscription to list a pet.
● Strict Restrictions:
○ Medical Proof: You must upload valid, recent health certificates/vaccinations. Failure to do so will result in listing rejection.
○ Cooldown Periods: To ensure animal welfare, the App enforces mandatory "Cooldown Periods" after breeding (e.g., 60-240 days). You agree not to bypass these limits.
● Vet Supervision Advisory: We strongly recommend that all mating activities take place under professional veterinary supervision. PetNimbus is not responsible for genetic defects, infection, injury, or adverse outcomes resulting from mating interactions.
● No Result Guarantee: We verify listings, but we do not guarantee a successful match, pregnancy, or healthy litter. Mating is a biological process outside our control. The subscription fee covers the listing service, not the biological outcome.
● Paid Features: Mating Listings, Premium Membership Plans, Reveal Tokens, Boosts, and Super Likes are paid services. Payments are processed via Razorpay.
● Taxes (GST): Prices displayed in the app may be exclusive of applicable taxes. GST (currently 18% for digital services) and other levies will be calculated and added to the final amount at the billing/checkout stage.
● Consumable Items (Tokens & Boosts): Purchases of "Reveal Tokens", "Profile Boosts", and "Super Likes" are consumable digital items. They are:
○ Non-Refundable: Once purchased, they cannot be refunded.
○ Non-Transferable: You cannot transfer them to another account.
○ Expiration: They may be subject to expiry if your account is inactive for 12 months or deleted.
● Price Changes & Notice: We reserve the right to change subscription plans or pricing at any time. Updating the pricing display on the relevant purchase screen (including but not limited to the Subscription Screen, Mating Registration Screen, or Product/Token Store Screen) shall constitute sufficient notice to you. It is your responsibility to check the price displayed on the screen before confirming your purchase.
● Our IP: All rights, title, and interest in the App (branding, logo, code, design, icons) belong to GoodShift Private Limited.
● Your Content: By uploading photos or data, you grant us a non-exclusive, royalty-free license to use, display, and modify your content for the purpose of operating and promoting the Service.
● Aggregated Data & Insights: We may analyze anonymized, non-personally identifiable data (e.g., breed popularity, dietary preferences, brand usage trends) to improve the Service and provide insights to partners (such as pet food brands). This data will never be linked to your specific identity or personal contact details without your explicit consent.
● Success Stories: If you share a "Success Story" (e.g., "Found my pet!"), you grant us a worldwide license to use that story and associated photos for marketing and promotional purposes.
● Automated Content Analysis: You acknowledge that we use automated systems (including Google Cloud Vision and OCR technology) to scan your uploaded photos and documents for:
○ Content Moderation: Detecting nudity, violence, or inappropriate content.
○ Verification: validating pet species and extracting text from medical/ID documents.
● Helper Badges: "Badges" and "Points" earned in the app have no monetary value. They are for community recognition only and can be revoked if we detect gaming of the system.
● "As Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. This means we provide the app in its current state, with all faults, and do not guarantee it will be bug-free, errorfree, or always online.
● Lost & Found Disclaimer (No Guarantee & Anti-Scam):
○ Free Emergency Service: The "Lost & Found" service is 100% FREE. PetNimbus will NEVER ask you for money to list a lost pet or to connect you with a finder. We consider this an emergency service.
○ Scam Warning: If anyone claiming to be from PetNimbus asks for payment to "release" your pet info or "boost" a lost alert, it is a SCAM. Do not pay them. Report such incidents immediately. We are not liable if you fall victim to third-party scams.
○ No Result Guarantee: We do not guarantee that your pet will be found. The success depends on community participation.
● Medical Disclaimer (AI & Nutrition):
○ AI Advice: Features like "AI Nutrition Plans" are generated by artificial intelligence. They are for informational purposes only and may not account for your pet's specific medical history or allergies.
○ Not a Vet: Content on PetNimbus does not constitute professional veterinary advice. Always consult a licensed veterinarian before changing your pet's diet or health regimen.
○ No Health Guarantee: We do not guarantee any specific health results (e.g., weight loss, muscle gain) from following the AI Nutrition Plans. Every animal is unique.
● Vaccine Tracking: Reminders for vaccinations are provided as a convenience feature only. We are not liable for any health consequences resulting from missed vaccinations due to technical failures, bugs, or undelivered notifications.
● Liability Limitation: To the maximum extent permitted by law, GoodShift Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Your use of the Service is also governed by our privacy and refund policies. By accepting these Terms, you also acknowledge that you have read and agreed to:

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar
